What air quality rules and regulations
apply to Perc Dry Cleaning operations?
Several key air quality rules and regulations apply
to dry cleaners. If you own or operate a perc dry cleaning business you are required to
have a current AQMD Permit to Operate and expected to understand and comply with all applicable local, state, and
federal requirements.

Permit-related rules
Rule
201 and Rule 203 cover permit
requirements. Unless equipment is specifically exempted from these requirements by
Rule 219, an
AQMD Permit to
Construct or Permit to Operate is required whenever:
- New equipment is installed, or
- Existing equipment is:
- Altered or moved to a new facility or location,
- Transferred to a new owner, or
- Operated under different or changed conditions.
Perc dry cleaning machines
are NOT exempt from permit requirements under
Rule 219.
Rule 212 - Standards
for Approving Permits and Issuing Public Notice. Under this rule, applicants
for an AQMD Permit to Construct or Permit to Operate must show that the equipment for
which they are seeking a permit may be expected to operate without emitting air
contaminants in violation of the California Health and Safety Code or AQMD Rules and
Regulations. In addition, applicants for a Permit to Construct or permit modification for
a project requiring notification are required to issue a public notice of the Executive
Officer's intent to grant a permit.
Rule 219 includes exemptions from permit
requirements for limited-capacity boilers and other utility-type equipment that may also
be used by perc dry cleaning operations. Check carefully to determine whether equipment
other than your perc dry cleaning machines may be exempt from permit requirements under
this rule.
Rule 1401 - New Source
Review of Toxic Air Contaminants. This rule authorizes AQMD to deny a Permit to Construct for a new,
relocated or modified permit unit if emissions of any toxic air contaminant (listed in Table I of the
rule) may occur, unless the applicant demonstrates to AQMD satisfaction that the risk per
year and the cumulative increases in Maximum Individual Cancer Risk (MICR) and in the
total acute and total chronic Hazard Index (HI) associated with these emissions falls at
or below specified levels. Specific requirements for Toxic Best Available Control
Technology (TBACT) include the installation of primary and secondary controls.
Emission control rules
Rule 1146.2 -
Emissions of Oxides of Nitrogen from Large Water Heaters and Small Boilers.
This rule applies to units that have a rated heat input starting at 75,000 Btu/hr up to
and including 2,000,000 Btu/hr. Boilers with a rated heat input between 400,00 1
million Btu/hr with a yearly fuel usage great than 9,000 therms must be retrofitted or
replaced by January 1, 2006, to meet the 30 ppm standard required by this rule.
Rule 1421 - Control of
Perchloroethylene Emissions from Dry Cleaning.
This rule identifies the types of dry cleaning and control equipment that may be installed
and operated within AQMD jurisdiction; describes equipment testing, vapor and liquid leak
check and repair requirements; details good operating practices; specifies requirements
for environmental training of equipment owners or operators; sets forth recordkeeping and
annual reporting requirements; and establishes a compliance schedule for new and existing
facilities. (Note: Petroleum Solvent Dry Cleaning operations are addressed separately
under AQMD Rule 1102.)
State Air Toxic Control Measures (California ATCMs)
California Code of Regulations (CCR)
Title 17, Section 93109, Emissions of Perchloroethylene from Dry Cleaning Operations. This ATCM sets
forth the equipment, training, operating, recordkeeping, and reporting requirements for
California dry cleaning operations. Provisions of this ATCM have been incorporated into
AQMD Rule 1421.
California Code
of Regulations (CCR) Title 17, Section 93110, Environmental Training program. This ATCM sets forth the criteria for the California Air
Resources Board (CARB) to approve a person or
organization applying to provide the training. Provisions of this ATCM have been
incorporated into AQMD Rule 1421.
National Emission Standards for Hazardous Air
Pollutants (NESHAP)
