PROPOSAL:
Proposed Amended Rule 317 – Clean Air Act Non-Attainment Fees
SYNOPSIS:
The public hearing for the proposed amended rule was continued
to the June Board meeting. The newly proposed amendments incorporate provisions
for an alternative baseline for calculating fees and an exemption for permit
units at BACT as requested by the Board at the April 2009 public hearing.

Background and Purpose
At the July 10, 2009 meeting, the Board continued the Public Hearing on this
item to September and directed staff to transmit a letter to U.S. EPA requesting
them to expeditiously finalize their implementation guidance on Section 185 of
the Clean Air Act and provide local districts and states with maximum
implementation flexibility including an exemption for units meeting BACT
standards. On August 20, AQMD received the attached response letter from U.S.
EPA. Based on the attached letter from U.S. EPA and the fact that U.S. EPA has
not yet finalized its review of the SJVAPCD Rule 3170, staff is recommending to
continue this item to December.
