A meeting of the South Coast Air Quality Management District Board will be held at 9:00 a.m., in the Auditorium at AQMD Headquarters, 21865 Copley Drive, Diamond Bar, California. Most agenda items and attachments are described in a “Board Letter” which may be accessed by clicking the appropriate link below. Unless otherwise noted, all agenda items are in .pdf format.

The agenda and documents in the agenda packet will be made available upon request in appropriate alternative formats to assist persons with a disability.     1. Set Public Hearing June 3, 2011 to Amend Rule 2005 - New Source Review for RECLAIM (PDF, 200kb)

      To offset emissions from a new or modified unit, Rule 2005 requires a RECLAIM facility to hold sufficient RECLAIM Trading Credits (RTCs) at the beginning of each year the unit is in operation, in addition to at the end of the compliance year, as for other RTC requirements. These RTC holding requirements may provide a disadvantage to modernization, potentially delaying emission reductions. The current proposal is to eliminate the requirement for existing facilities to hold RTCs in advance of second and subsequent years. All emissions will still be offset by RTCs at the end of the applicable compliance period. (Reviewed: Stationary Source Committee, January 21, 2011)

      Proposed Rule 310.1 - Amnesty for Unpermitted Equipment and Small Business Discount for Control Equipment will exempt owners and operators of unpermitted equipment that meet certain conditions from civil and criminal penalties and late filing fees if the necessary permit applications and fees are voluntarily filed and paid during the amnesty period of July 1, 2011 through December 31, 2011. In addition, the proposed rule provides an additional 50 percent discount to small businesses filing complete applications to install control equipment during the same time period. This rule implements Board direction to incentivize compliance and encourage emission reductions. (Review: Administrative Committee, May 13, 2011)

    3. Set Public Hearing July 8, 2011 to Amend Rule 1147 – NOx Reductions from Miscellaneous Sources

      To respond to compliance challenges currently being experienced, staff is recommending delay of the NOx emission limit compliance dates for equipment subject to Rule 1147. The proposed rule also limits the requirements for fuel and time meters. PAR 1147 will also reduce compliance cost due to emissions testing and clarify existing requirements. PAR 1147 will result in delayed emissions reductions from equipment subject to this rule. However, PAR 1147 would achieve the same reductions as the existing rule by 2014. Budget/Fiscal Impact

  1. Execute and Amend Contracts for Implementation of U.S. EPA’s Targeted Air Shed Grant Program (PDF, 32kb)

    The AQMD’s Clean Communities Plan identifies San Bernardino and Boyle Heights as two areas to begin pilot programs to reduce community-based exposure. On March 4, 2011, the Board recognized funding from U.S. EPA’s Targeted Air Shed Grant for eight incentive programs to assist in implementation of the Clean Communities Plan. This action is to address contracts needed to implement two of these incentive programs by requesting the Board to: 1) execute a sole source contract for the Auto Refinishing Transfer Efficiency program, and 2) revise and extend an existing contract for the Fireplace Gas Log Buy-Down incentive program.   2. Amend Contract to Provide Technical Support for AQMD Coachella Valley Meteorological Network (PDF, 19kb)

    On June 6, 2008, the Board awarded a new contract with Technical and Business Systems, Inc. to provide technical support for the AQMD Coachella Valley Meteorological Monitoring Network, with options for three annual contract renewals. This action is to amend the Technical and Business Systems, Inc. contract for the next year of field support and data management for the Coachella Valley measurement program at a cost not to exceed $60,000. This exercises the third of three renewal options based on the contractor’s responsiveness and satisfactory performance, bringing the contract total to $225,000. Funding for this contract amendment is included in the FY 2010-11 Budget. (Reviewed: Administrative Committee, April 8, 2011; Recommended for Approval)

  3. Issue Purchase Order for Calibration Gas Dilution Systems and Primary Ozone Standard (PDF, 43kb)

    In November 5, 2010, the Board approved the release of an RFQ for the acquisition of six Calibration Gas Dilution Systems for use in ambient air monitoring calibrations as budgeted in the 19th year PAMS program. A review panel was convened to evaluate the three bids received, and Teledyne-API was selected as the recommended vendor. The purchase of a Primary Ozone Standard was also included in the 19th year PAMS budget, and an informal bid process resulted in the selection of Tanabyte Engineering. This action is to issue a purchase order to Teledyne-API to purchase two NCore ready dilution systems and four ambient dilution systems at a total cost not to exceed $85,310. This action is also to issue a purchase order for one Primary Ozone Standard at a cost not to exceed $8,341 from Tanabyte Engineering.   4. Execute Contract To Electrify Ship to Receive Shore Power with U.S. EPA Grant Funds (PDF, 19kb)

    In June 2010, the Board recognized $5 million from U.S. EPA for three projects, including one project to install shore power infrastructure. This action is to execute a contract with Carnival Cruise Lines to electrify a passenger cruise vessel to receive shore power at the Long Beach Cruise Terminal in an amount not to exceed $1,600,000.   5. Execute Contracts to Demonstrate NOx and PM Emission Controls on Construction Equipment in Showcase Program (PDF, 27kb)

    The Board previously awarded contracts to two different entities to demonstrate retrofit control technologies on off-road construction equipment as part of the Off-Road Emissions Reduction Showcase Program. Unfortunately, both companies have withdrawn or partially withdrawn from the program. This action is to reallocate the unspent funds and execute contracts with Diesel Emission Technology, Inc., Tehag AG, and Puritech GmbH & Co. KG for the Showcase Program in an amount not to exceed $189,000 from the Clean Fuels Fund. (Reviewed: Technology Committee, April 15, 2011; Recommended for Approval)

    On February 4, 2011 the Board approved three priority goals for the agency in 2011. One priority goal is to develop and demonstrate up to five megawatts of in-basin renewable distributed electricity generation combined with storage to support electric technology applications. This action is to issue an RFP to announce the availability of funds and solicit proposals to compete for financial assistance for these projects. Funding from AQMD in an amount of $30 million or more will be made available through this RFP. (Reviewed: Technology Committee, April 15, 2011; Recommended for Approval)

  7. Execute Contract Under Carl Moyer Program and Issue Program Announcement for SOON Provision (PDF, 657kb)

    On October 1, 2010, the Board awarded projects under the “Year 12” Carl Moyer Program and SOON Provision. Staff has continued working with applicants and has identified an additional project. This action is to execute a contract under the Carl Moyer Program in an amount not to exceed $57,895 from the Carl Moyer Program Fund with J.A. Placek Construction. This action is also to issue a new Program Announcement to provide funding assistance for off-road equipment subject to the SOON Provision.     This action is to purchase 14 CNG vehicles based on the CalStart NGV Co-Op. Under Section IV.A.5 of the AQMD Procurement Policy and Procedure, the Procurement Manager shall pursue cooperative purchasing opportunities whenever possible. DCH Gardena Honda was the winning bidder for the CNG subcompact 4-door passenger car category with the Honda Civic GX. Although their pricing was contingent upon a federal tax credit which expired at the end of 2010, the vendor has agreed to honor the price with a $2,000 cost adjustment due to the loss of the credit. The cost of this purchase would not exceed $405,000 and funds are available in the FY 2010-11 Budget. (Reviewed: Administrative Committee, April 8, 2011; Recommended for Approval)

  9. Execute Contract for Workers' Compensation Claims Third-Party Administration (PDF, 38kb)

    The current contract for workers' compensation claims administration services expires June 30, 2011. On January 7, 2011, the Board approved release of an RFP to solicit proposals from firms interested in providing these services. This action is to execute a new three-year contract with ACME Administrators Inc., through June 30, 2014, for a total amount not to exceed $120,444. Funding for this contract has been requested in the FY 2011-12 Budget, and will be requested in successive fiscal years. (Reviewed: Administrative Committee, April 8, 2011; Recommended for Approval)

  10. Amend Policy Pertaining to Board Assistants/Consultants Vehicle Mileage Traveled and other Travel Expenses (PDF, 35kb)

    This item is to consider amendments to the AQMD Board Member Assistant and Board Member Consultant Policy to allow for the reimbursement of vehicle mileage reimbursement, at the rate set forth in Administrative Code section 110.4, for travel within the geographical boundaries of the District. In addition, this item is to consider amendments to allow for reimbursement to a Board Member Assistant or Board Member Consultant to the Board Member(s) serving as the District’s CARB representative or the District’s California Fuel Cell Partnership (CaFCP) representative for necessary expenses related to attending CARB or CaFCP functions, subject to advance approval by the Board Chair.   11. Approve Contract Awards and Issue RFP for Programmatic Outreach Services under FY 2010-11 AB 2766 Discretionary Fund Work Program (PDF, 565kb)

    The MSRC issued a Program Announcement to solicit applications for transportation programs to assist congested event centers. On April 21, 2011, the MSRC awarded a contract to Orange County Transportation Authority for a program to provide Angel Game Metrolink Service. The MSRC also qualified two vendors, A-Z Bus Sales and BusWest, to implement the MSRC’s Alternative Fuel School Bus Incentive Program, and awarded a contract in the amount of $300,000 to each vendor. The MSRC also approved release of an additional RFP under the FY 2010-11 Work Program to solicit proposals for Programmatic Outreach Services for November 2011 through October 2013. For the last several years the MSRC has retained a consultant to provide programmatic outreach services. The current consultant contract expires in November 2011. At this time the MSRC seeks Board approval of the contract awards and to release the RFP under the FY 2010-11 AB 2766 Discretionary Fund Work Program.     On January 7, 2011, the Board released a Program Announcement to solicit eligible projects in the category of “ships-at-berth” for the Proposition 1B-Goods Movement Emission Reduction Program. This funding opportunity applies to projects at ports and intermodal rail yard facilities located in the Los Angeles/Inland Empire trade corridor and at Port Hueneme. This action is to approve ships-at-berth projects, subject to CARB’s final approval, in an amount not to exceed $58,226,334. This action is also to amend contracts with consultants to assist in implementation of incentive programs. (No Committee Review)

    The Executive Officer's Budget for FY 2011-12 represents the input over the past several months from Board Members, staff and the public. This year's process included meetings of the Budget Advisory Committee; a public hearing on February 4, 2011 to receive input on the AQMD's Program Goals and Objectives; and two budget workshops, one for the public held on April 12 and one for the Board held on April 22, 2011. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget. The proposed budget incorporates the CPI adjustment pursuant to Rule 320.   31. Adopt Proposed Rule 1325 – Federal PM2.5 New Source Review Program

    The District is required to submit a rule that incorporates U.S. EPA’s New Source Review requirements for PM2.5 by July 11, 2011 for inclusion into the SIP. Proposed Rule 1325 is designed to fulfill this requirement and would apply to 1) new major polluting facilities of PM2.5 or precursors in the South Coast Air Basin; 2) existing major polluting facilities of PM2.5 or precursors undergoing major modifications; and 3) any existing facility with an emissions increase or a potential to emit 100 tons per year or more of PM2.5 or any of its precursors.   32. Annual Report for 2010 on AB 2588 Air Toxics Hot Spots Program (PDF, 601kb)

    The Air Toxics "Hot Spots" Information and Assessment Act of 1987 (AB 2588) requires local air pollution districts to prepare an annual report. Key accomplishments for 2010 include: (1) reviewed nine facility health risk assessments (HRAs) which included four refineries, (2) notified two facilities to prepare HRAs, (3) conducted industry-wide risk assessment for retail gas stations, (4) supported and reviewed U.S. EPA’s 2005 National-Scale Air Toxics Assessment, (5) updated the AQMD’s prioritization procedures, and (6) updated AB 2588 website information.
