Proposed Amended Rule 1193 – Clean On-Road Residential and Commercial Refuse Collection Vehicles

Purpose of the Meeting

The South Coast Air Quality Management District (SCAQMD) is inviting you to a public workshop to solicit information and suggestions on proposed amendments to Rule 1193, applicable to public fleet operators and privately owned fleets providing refuse collection services to government agencies.  The amendments may be revised based on comments received at the public workshop and on written comments.  The proposed amendments are scheduled for a public hearing on December 4, 2009.

Air Quality Objective

The South Coast Air Quality Management District adopted a series of rules that require the increased use of cleaner fleet vehicles in the SCAQMD.  The objective of the amendments is to make changes to the existing rule language in order to facilitate implementation.

Rule amendments are proposed to clarify the application to the purchasing decisions of state and local government entities, or of private entities under contract to or operating under an exclusive license or a franchise with state and local government entities. 

Proposal

The SCAQMD staff seeks your input on proposed amendments to Rule 1193 that would revise rule language for consistency with court decisions, and would specify that Rule 1193 applies to state and local government agencies, and to private entities that provide refuse collection services to one or more of these government agencies.  In addition, amendments are proposed to address solid waste collection services and to establish procedures for when rule compliant vehicles are on order but have not been delivered by the start of service, as well as the use of backup vehicles due to vehicle breakdown.

California Environmental Quality Act

Staff is evaluating the proposed project, and pursuant to the California Environmental Quality Act (CEQA) and SCAQMD Rule 110, appropriate CEQA documentation will be prepared for proposed amended Rule 1193.  Comments or questions regarding CEQA for the proposed project should be directed to:
