Proposed Rule 1155 – Particulate Matter (PM) Control Devices

NOTICE IS HEREBY GIVEN that a public hearing on the matter of adoption of rules and regulations for the South Coast Air Quality Management District (AQMD), or amendments thereto, will be held on Friday, December 4, 2009 in the Auditorium at AQMD Headquarters, 21865 Copley Drive, Diamond Bar, CA, at 9:00 a.m., or later, at which time evidence will be taken and all interested persons will be heard by the AQMD Board.

NOTICE IS FURTHER GIVEN that the original public hearing scheduled for November 6 has been postponed to December 4, 2009 in order to allow staff to conduct additional analysis and address comments received from U.S. Environmental Protection Agency and the California Air Resources Board.

NOTICE IS FURTHER GIVEN that the AQMD is considering the adoption of Proposed Rule 1155 – PM Control Devices to establish minimum performance, maintenance, and source test requirements for permitted PM control devices venting direct PM to ensure the proper operation and maintenance of such equipment.  Visible emissions monitoring, some equipment upgrades and installation, and installation of monitoring equipment is also being proposed.

NOTICE IS FURTHER GIVEN that the air quality objective of Proposed Rule 1155 is to ensure the proper functioning of PM control devices.

NOTICE IS FURTHER GIVEN that the AQMD has prepared documents, for consideration by the AQMD Board, including: 

  • Proposed Rule 1155 – PM Control Devices
  • Staff Report for Proposed Rule 1155
  • Draft Environmental Assessment for Proposed Rule 1155 pursuant to the California Environmental Quality Act (CEQA)
  • Draft Socioeconomic Impact Report

Health and Safety Code §40727.2 (a) states that a comparative analysis is required to analyze any “existing or proposed rule and regulations that apply to the same equipment or source type.”  The analysis pursuant to this requirement is contained within the staff report.

NOTICE IS FURTHER GIVEN that at the conclusion of the public hearing, the AQMD Board may make amendments to Proposed Rule 1155 – PM Control Devices, which are justified by the evidence presented, or may decline the amendments.

Interested persons may attend and submit oral or written statements at the Board Hearing.  Twenty-five (25) copies of all written materials must be submitted to the Clerk of the Boards.  Individuals who wish to submit written comments for review prior to the public hearing must submit such comments to the Clerk of the Boards, 21865 Copley Drive, Diamond Bar, CA, 91765, (909) 396-2500, or to cob@aqmd.gov on or before Tuesday, November 24, 2009.  Electronic submittals will only be accepted if no more than 10 pages including attachments; and in MS Word, plain or HTML format.
