    Determine That Proposed Rule 118.1 – Public Safety Provisions for Stationary Emergency Standby Engines and Proposed Amended Rule 1470 – Requirements for Stationary Diesel-Fueled Internal Combustion and Other Compression Ignition Engines Are Exempt from CEQA, and Adopt Proposed Rule 118.1 and Amend Rule 1470

    Over the past several years, utilities have increased implementation of Public Safety Power Shutoff events where power lines are de-energized to reduce potential wildfires. As a result, critical service facilities have increased operation of emergency standby engines during Public Safety Power Shutoff events to provide continuous services to protect public health and safety. Proposed Rule 118.1 includes provisions for critical service facilities that operate an emergency standby engine during a Public Safety Power Shutoff event. Proposed Amended Rule 1470 provides an optional testing and maintenance schedule for water and sewage facilities with an emergency standby engine located in a very high fire hazard severity zone. This action is to adopt the Resolution: 1) Determining that Proposed Rule 118.1 - Public Safety Provisions for Stationary Emergency Standby Engines and Proposed Amended Rule 1470 – Requirements for Stationary Diesel-Fueled Internal Combustion and Other Compression Ignition Engines, are exempt from the requirements of the California Environmental Quality Act; and 2) Adopting Proposed Rule 118.1 - Public Safety Provisions for Stationary Emergency Standby Engines and Amending Rule 1470 – Requirements for Stationary Diesel-Fueled Internal Combustion.     3. Execute Agreement to Establish Wildfire Smoke Clean Air Centers Incentive Pilot Program, Recognize Funds, Release RFP, Execute Contracts, and Reimburse General Fund

    AB 836 provided $5 million in statewide funding to create a Wildfire Smoke Clean Air Centers for Vulnerable Populations Incentive Pilot Program to upgrade ventilation systems and provide portable air cleaners to create a network of Wildfire Smoke Clean Air Centers for residents displaced by wildfires and other smoke events. These actions are to execute an agreement with CARB to establish a Wildfire Smoke Clean Air Centers Incentive Pilot Program, recognize up to $250,000 from CARB into the Air Filtration Fund (75), release RFP #P2022-04 to solicit organizations to purchase portable air cleaners at Wildfire Smoke Clean Air Centers, execute contracts with organizations to purchase eligible CARB-certified portable air cleaners and replacement filters at Wildfire Smoke Clean Air Centers in an amount up to $231,250 from the Air Filtration Fund (75), and reimburse the General Fund for administrative costs up to $18,750.   • 4. Approve Additional Funding for Residential Electric Lawn Mower Rebate Program

    The Residential Electric Lawn Mower Rebate Program provides rebates to help offset the purchase cost of new electric lawn mowers. Participants who purchase a new electric lawn mower receive their rebate after applying online and scrapping their old gasoline-powered lawnmower at a participating licensed dismantler. This action is to approve the use of a total amount not to exceed $250,000 from the Rule 2202 Air Quality Investment Fund (27) to continue the year-round Residential Electric Lawn Mower Rebate Program.   • 5. Amend Awards for Zero-Emission Yard Tractor Replacements and for Ocean-Going Vessel Retrofit and Execute Contract for Capture and Control System for Oil Tankers Project Support

    In October 2017 and September 2020, the Board approved $1,260,000 awards to Total Terminals International (TTI) for yard tractor replacements and $11,474,000 to MAN Energy Solutions USA, Inc. (MAN) for Ocean-Going Vessel retrofit development, respectively. Both companies are not able to fulfill the original award requirements, so staff is recommending other companies to perform this work. In January 2021, the Board recognized an award from CARB to develop and demonstrate a capture and control system for oil tankers. Coalition for Clean Air will provide education and outreach support for this project. These actions are to 1) amend award from TTI to SSA Terminals LLC and execute a contract for electric yard tractors replacement; 2) amend award from MAN to Mediterranean Shipping Company USA, Inc. and execute a contract for Ocean-Going Vessel retrofit development; and 3) execute a contract with Coalition for Clean Air to provide education and outreach support for the Capture and Control System for Oil Tankers Project.   • 6. Amend Awards Under Year 22 Carl Moyer and Surplus Off-Road Opt-In for NOx (SOON) Programs, and Transfer Funds for Development of Carl Moyer Program Grant Management System

    In January 2021, the Board approved awards for projects received under Program Announcements for the Year 22 Carl Moyer and Surplus Off-Road Opt-In for NOx (SOON) Programs, which includes funding from other sources. Staff has identified projects that require adjustments and is requesting Board approval to amend awards under the Carl Moyer and SOON Programs. Also, this action is to appropriate up to $120,000 from the administrative portions of both the Community Air Protection Program Fund (77) and the Carl Moyer Program SB 1107 Fund (32) into Information Management’s FY 2021-22 Budget, Professional and Special Services and/or Capital Outlays Major Objects and reimburse the General Fund (01) using administrative funds for development of the Carl Moyer Program Grant Management System.   • 7. Issue RFP for Legislative Representation in Washington, D.C.

    The current contracts for legislative representation in Washington, D.C. expire on January 14, 2022. This action is to issue an RFP for legislative representation and consulting services for South Coast AQMD in Washington, D.C. for 2022.   • 8. Appropriate Funds for Consultant Services for South Coast AQMD's Environmental Justice Outreach and Initiatives and Clean Air Program for Elementary Students and Why Healthy Air Matters Program

    At the September 2, 2020 meeting, the Board appropriated funds for the Environmental Justice Outreach and Initiatives and Clean Air Program for Elementary Students (CAPES) at $360,000 per year in FY 2021-22 and FY 2022-23 and the Why Healthy Air Matters (WHAM) Program to add $1,000,000 per year in FY 2021-22 and FY 2022-23. Funding was to be provided from 20 percent of the annual penalty money received in excess of $4 million from the General Fund. Sufficient annual penalty funding is not available for the Environmental Justice Outreach and Initiatives and CAPES program and WHAM in FY 2021-22 based on this formula, and Board action is required to provide supplemental funding from BP ARCO Fund (Fund 46).   • 9. Appropriate Funds for Planning, Organizing, and Facilitating South Coast AQMD’s Martin Luther King, Jr. Day of Service Forum and Cesar Chavez Day of Remembrance

    At the January 8, 2021 meeting, the Board authorized the Chairman to execute a sole-source three-year Contract with Lee Andrews Group, Inc., for planning, organizing and facilitating two annual air quality events, in amount not to exceed $150,000 per year; and authorized the appropriation of $450,000 from General Fund, Undesignated Fund Balance, to the Legislative, Public Affairs, & Media FY 2021-21 Budget, Services and Supplies Major Object. Due to a delay in executing the contract, the previously authorized appropriation reverted to the General Fund, Undesignated Fund Balance. This action is to authorize the previously approved FY 2020-21 appropriation to Legislative, Public Affairs, & Media FY 2021-22 Budget, Services and Supplies Major Object.   • 10. Amend FY 2021-22 Budget to Address Operational Needs, and Add/Revise Job Titles for Various Class Specifications

    This item is to amend the FY 2021-22 Budget to add and delete positions in several divisions in order to address operational needs. This item is also to revise the job titles for two Director positions, add a Director position title, and revise job titles for six clerical classifications and the Senior Public Information Specialist position. Funding for the budget amendments is available in the FY 2021-22 General Fund Undesignated (Unassigned) Fund Balance and will be requested in future budgets.   • 11. Authorize Purchase of Microsoft Office 365

    South Coast AQMD currently uses Office 365 for word processing, spreadsheets, email, and collaboration. The current Office 365 licensing expires on January 31, 2022. This action is to authorize the purchase of Microsoft Office 365 licenses for a period of three years in the amount not to exceed $380,000 per year.   • 12. Amend Contract to Provide Short- and Long-Term Systems Development, Maintenance and Support Services

    South Coast AQMD currently has contracts with several companies for short- and long-term systems development, maintenance and support services. These contracts are periodically amended as additional needs are defined. This action is to amend contracts previously approved by the Board to add additional funding for needed development and maintenance work in an amount not to exceed $240,000 for AgreeYa Solutions, $60,500 for Prelude Systems, $232,500 for Sierra Cybernetics, and $39,000 for Varsun eTechnologies.   • 13. Approve Contract Modification and Bifurcation of Award and Issue RFP as Approved by MSRC

    The MSRC approved a modification to a contract under the Local Government Match Program as part of their FYs 2014-16 Work Program. The MSRC also approved the bifurcation of a previous award under the Zero and Near-Zero Emission Cargo Handling Equipment in Riverside and San Bernardino Counties Program as part of their FYs 2018-21 Work Program. In addition, the contract for the MSRC’s Technical Advisor expires December 30, 2021. To ensure continuation of these services the MSRC approved the release of an RFP to solicit Technical Advisor services. At this time, the MSRC seeks Board approval of the modification and bifurcation as part of the FYs 2014-16 and 2018-21 Work Programs and to release the RFP.     34. Determine That Proposed Amendments to Rule 1111 – Reduction of NOx Emissions from Natural-Gas-Fired, Fan-Type Central Furnaces, Are Exempt from CEQA; and Amend Rule 1111

    Rule 1111 establishes a NOx emission limit of 14 ng/J for residential and commercial gas furnaces. Proposed Amended Rule 1111 will extend the mitigation fee alternative compliance option end date from September 30, 2021 to September 30, 2023 for mobile home furnaces, extend the high-altitude (≥ 4,200 feet above sea level) exemption end date from September 30, 2021 to December 31, 2021, and provide an exemption for downflow and large-sized (≥100,000 btu/hr) condensing or non-condensing furnaces being replaced in the high-altitude areas. This action is to adopt the Resolution: 1) Determining that the proposed amendments to Rule 1111 – Reduction of NOx Emissions from Natural-Gas-Fired, Fan-Type Central Furnaces are exempt from the requirements of the California Environmental Quality Act; and 2) Amending Rule 1111 – Reduction of NOx Emissions from Natural-Gas-Fired, Fan-Type Central Furnaces. Members of the public are afforded an opportunity to speak on any agenda item before consideration of that item. Persons wishing to speak may do so remotely via Zoom or telephone. Speakers may be limited to a total of three (3) minutes for the entirety of the Consent Calendar plus Board Calendar, and three (3) minutes or less for each of the other agenda items.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under the Public Comment Period may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record.
